BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO THESE OFFICIAL RULES AND THE KRAKEN.COM TERMS OF SERVICE, WHICH EACH FORM A CONTRACT. READ THEM CAREFULLY BEFORE ENTERING. NO PURCHASE NECESSARY FOR THE GRAND PRIZE SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Sponsor
This Promotion (“Promotion”) is sponsored by Payward, Inc., known as Kraken (“Sponsor” or “Kraken”), 1209 Orange St., Wilmington, DE 19801.
2. Promotion Structure
The Promotion consists of two components:
1. Daily Drop Contest (skill-based) — 10 winners selected each day based on creativity.
2. Grand Prize Sweepstakes — 1 winner selected at random from all eligible entries, including AMOE entries submitted via Sweeppea.
Each component is governed by these Terms.
3. Eligible Areas
Open to eligible Kraken customers who receive communications inviting them to opt in to this promotion. Not available in certain jurisdictions, including the United Kingdom, countries outside of the EEA, and anywhere prohibited by law.
4. Promotion Period
The Promotion begins on December 18, 2025 at 9:00 AM UTC and ends on December 23, 2025 at 11:59 PM UTC. Each calendar day during the Promotion Period constitutes a separate Daily Drop Contest period.
5. How to Participate
5.1 Daily Drop Contest (Skill-Based)
To receive one entry for that day’s Daily Drop, participants must:
1. Follow @Krak on X (Twitter);
2. Respond to the Daily Drop post with:
- Which mission was completed; and
- A picture related to the mission + Krak branding;
3. Send @Krak a DM containing:
- A link to the participant’s tweet;
- Their Kraktag;A screenshot of the Krak Card transaction showing:
- the RefID, and
- the date, which must match the date of the Daily Drop post.
Entry Limit:
Up to 6 entries per day (one per mission), missions may be repeated across days.
5.2 Grand Prize Sweepstakes (Game of Chance + AMOE)
To enter the Grand Prize Sweepstakes, a participant must:
- Complete all six Krakmas missions at least once during the Promotion Period and complete the Daily Drop participation steps above OR
- Submit a valid Alternative Method of Entry (AMOE) via Sweeppea at https://swpp.me/a/krakmas.
Entry Limit:
Maximum 1 entry per person for the Grand Prize Sweepstakes.
Paid-entry and AMOE entries are of equal dignity, and neither increases the chance of winning.
6. Prizes
6.1 Daily Drop Contest Prizes
- 10 winners per day, each receiving a refund of their Krak Card purchase for the mission completed, up to €100.
- Approximate total daily value: €1,000.
- Total Daily Drop prize pool: €6,000.
6.2 Grand Prize Sweepstakes Prize
- One (1) winner will receive €25,000.
Total Promotion prize pool: €31,000.
Prizes are non-transferable, non-exchangeable, and no cash substitute is permitted except as determined by Kraken.
7. Winner Selection
7.1 Daily Drop Contest
Winners are selected by Kraken based on creativity of the submitted content. This is a skill-based contest.
7.2 Grand Prize Sweepstakes
Winner is selected at random from all eligible entries, including AMOE entries. The drawing will occur after the Promotion Period.
8. Eligibility
Participants must, at the time of entry and throughout the Promotion:
- Reside in an eligible EEA jurisdiction;
- Have a valid Krak account (consumer level) with Tier 1 KYC;
- Agree to these Terms and the Kraken.com Terms of Service;
- Not be otherwise prohibited by law.
9. Disqualification
Kraken may disqualify any participant who:
- Violates these Terms or the Kraken.com Terms of Service;
- Provides false or misleading information;
- Engages in fraudulent, abusive, harmful, or manipulative behavior;
- Uses multiple accounts or attempts to circumvent entry limits;
- Submits content violating Kraken policies or applicable law.
10. Notification & Prize Delivery
- Daily Drop winners will be notified via DM and refunded within 30 days after verification.
- The Grand Prize winner will be notified using email.
- Accounts must be active and in good standing for a prize to be issued.
- Kraken may request additional documentation prior to award issuance.
11. Consents and Approvals
Per the model terms:
By entering, participants consent to Kraken’s use of submission content and personal information for administering the Promotion and as permitted under Kraken’s Privacy Notice:
Participant information may be disclosed to third parties where required for prize administration or legal compliance.
12. Disclaimers
Consistent with EU model terms:
Kraken is not responsible for internet outages, technical errors, delays, or other events beyond its control, including acts of God, equipment failures, severe weather, or governmental actions.
13. Limitation of Liability; Disputes; Governing Law
This section uses the Canada-model dispute language required for all EU-only promotions:
Participants release Kraken and all Related Parties from any claims arising from participation or prize use.
To the extent permitted by law:
- All disputes will be resolved individually, without class action;
- Claims are limited to actual out-of-pocket costs (max €25);
- Punitive, consequential, and special damages are waived;
- Remedies are limited to monetary damages.
Governing Law:
The Promotion is governed by the laws of England & Wales.
Arbitration:
All disputes shall be resolved by confidential binding arbitration in London, England, under LCIA rules.
Kraken may seek equitable relief in any competent court.
14. Taxes
Participants are solely responsible for any tax obligations arising from receipt of a prize.
15. General Rules
Kraken may modify, suspend, or terminate the Promotion at any time due to fraud, technical issues, or any circumstance affecting its integrity.
Failure to enforce any provision does not constitute a waiver.
If any provision is found invalid, remaining terms remain enforceable.
