BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO THESE OFFICIAL RULES AND THE KRAKEN.COM TERMS OF SERVICE, WHICH EACH FORM A CONTRACT. READ THEM CAREFULLY BEFORE ENTERING. NO PURCHASE, PAYMENT, OR FUNDING NECESSARY TO PARTICIPATE OR WIN. PURCHASE, PAYMENT, OR FUNDING WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Sponsor

This promotion (“Promotion”) is sponsored by Payward, Inc., known as Kraken (“Sponsor” or “Kraken”).

2. Eligible Areas

The Promotion is open only to eligible customers residing in Germany.
Excluded are areas where Kraken does not operate or where such promotions are restricted or prohibited by law.

3. Promotion Period

The Promotion begins on the date it is made available to eligible participants and ends on January 20, 2027, unless terminated earlier by Kraken in its sole discretion. Kraken reserves the right to modify, suspend, or end the Promotion at any time.

4. How to Participate

To qualify for the Promotion, you must:

A. Create a Kraken Consumer or Pro account (new users only);
B. Complete Intermediate level KYC verification;
C. Make a qualifying deposit of at least €100 into your Kraken account using an eligible funding method during the Promotion Period;
D. Complete trades totaling at least €100 in non-stablecoin cryptocurrencies within the first 30 days of creating your Kraken account.

Card payments are expressly excluded. Deposits made via credit cards, debit cards, or prepaid cards do not qualify as eligible funding methods for this Promotion.

Limit: One (1) reward per participant.

5. Reward

Each eligible participant will receive a reward of Bitcoin (BTC) equivalent to €30 in value (Approximate Retail Value: €30), credited to their Kraken account within 30 days after Kraken confirms compliance with these Official Rules.

Eligible trades must be in non-stablecoin cryptocurrencies.
Eligible deposits must exclude card-based payment methods.

The reward is non-transferable, non-exchangeable, and may not be redeemed for cash. Kraken may substitute a reward of equal or greater value at its sole discretion.

6. Eligibility to Participate

You are eligible to participate in the Promotion if, at the time of entry and during the Promotion:

You reside in Germany;
You have created and verified a Kraken Consumer or Pro account to the Intermediate KYC level;
You agree to the Kraken.com Terms of Service;
You are not a “Kraken Related Party”;
You are not otherwise ineligible under applicable law.

“Kraken Related Parties” include employees, officers, directors, managers, agents, consultants, or representatives of Kraken, and their family members (spouse, parents, grandparents, siblings, children, and grandchildren, including step-relations), as well as Kraken’s corporate partners, subsidiaries, affiliates, successors, and advertising or PR agencies.

By participating, you represent and warrant that you meet all eligibility requirements.

7. Disqualification

Kraken reserves the right to disqualify any participant if it determines, in its sole discretion, that the participant has:

Violated these Official Rules or the Kraken.com Terms of Service;
Provided false or misleading information;
Engaged in fraudulent, abusive, or manipulative behavior;
Attempted to circumvent limits, including by creating multiple accounts.

8. Notification of Reward

Rewards will be automatically credited to eligible Kraken accounts within 30 days after qualification. If an account is closed, suspended, or not in good standing at the time of distribution, Kraken may withhold or cancel the reward.

9. Consents and Approvals

By entering the Promotion, you consent to Kraken’s use of information submitted or collected in connection with the Promotion, including for administration, compliance, and marketing communications. Kraken may share identifying information with third parties as required to administer the Promotion and comply with applicable law.

10. Disclaimers

Kraken is not responsible for any technical issues, network failures, or other circumstances beyond its reasonable control that may interfere with participation in the Promotion. Kraken and Kraken Related Parties shall not be liable for losses caused by force majeure events, including but not limited to acts of God, war, natural disasters, epidemics, labor disputes, or governmental actions.

11. Limitation of Liability, Disputes, and Governing Law

By participating, you release and hold harmless Kraken and Kraken Related Parties from any claims arising from participation in the Promotion or receipt or use of the reward.

TO THE EXTENT PERMITTED BY APPLICABLE LAW:

All disputes shall be resolved individually and not as part of any class action;
Any recovery shall be limited to actual out-of-pocket costs, not to exceed $25 USD;
Punitive, incidental, consequential, or special damages are waived;
Remedies are limited to monetary damages, and injunctive or equitable relief is waived.

Any dispute arising out of or relating to this Promotion shall be governed by the laws of England and Wales, without regard to conflict-of-law principles, and shall be resolved by confidential binding arbitration in London, England, under the LCIA Rules. Kraken may seek equitable relief in any court of competent jurisdiction.
