KRAK-OR-TREAT GIVEAWAY – OFFICIAL TERMS

BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO THESE OFFICIAL TERMS AND THE KRAKEN.COM TERMS OF SERVICE , WHICH EACH FORM A CONTRACT. READ THEM CAREFULLY BEFORE ENTERING. 1. Sponsor

This promotion (“Promotion”) is sponsored by Payward, Inc., 1209 Orange St., Wilmington, Delaware 19801, USA (“Kraken” or “Sponsor”).

2. Eligible Areas

Worldwide, excluding the regions and countries that Kraken does not serve, which are set forth on this website. Also excluding: Australia, Canada, Singapore, United Kingdom; United States residents of Maine, New York, and Texas; and Canada. Void where prohibited by law.

3. Promotion Period

Begins October 31, 2025 at 10:00 a.m. Eastern Time and ends November 2, 2025 at 11:59 p.m. Eastern Time (“Promotion Period”).

4. How to Enter

During the Promotion Period:

1. Follow @Krak on X (formerly Twitter); and
2. Respond in the comments with your @Kraktag (as found in the Krak app) and feedback on the Krak app.

Entries are free of charge. Limit one (1) entry per person/account.

5. Disclaimers

Ten (10) winners will each receive $50 USDG, credited to their eligible Krak account. Approximate Retail Value (ARV): US $500. The Sponsor may substitute a prize of equal or greater value if necessary.

6. Winner Selection and Notification

Winners will be selected in a random drawing from all eligible entries received during the Promotion Period. Drawing will be conducted by Kraken within ten (10) business days after the Promotion Period ends. Winners will be notified via the in-app Krak messaging system or by email associated with their Kraken account. Prizes will be credited to eligible winners’ accounts within thirty (30) days of verification. Accounts must be active and in good standing at the time of crediting.

7. Eligibility Requirements

Participants must:

• Hold a valid Kraken account (Tier 1 KYC verification or higher);
• Be at least 18 years old (or the age of majority in their jurisdiction, if higher); and
• Comply with these Rules and Kraken’s Terms of Service.

8. Disqualification

Kraken reserves the right to disqualify any entrant for violating these Rules, Kraken’s Terms of Service, or applicable law, or for fraudulent or abusive activity, multiple accounts, or other manipulation of the Promotion.

9. Consents and Privacy

10. Limitation of Liability; Disputes; Governing Law

To the maximum extent permitted by law, you release and hold harmless Kraken, its affiliates, and their officers, employees, and agents from any and all claims arising out of participation in this Promotion or receipt or use of any prize. All disputes arising from or relating to this Promotion will be governed by the laws of England and Wales, without regard to conflicts of law principles, and resolved by confidential binding arbitration in London, England, administered by the LCIA. Judgment on the award may be entered in any court of competent jurisdiction. Kraken may seek equitable relief in any competent court.

11. Taxes

Participants are solely responsible for any taxes associated with the receipt of a prize. Kraken does not provide tax advice.

12. General Rules

Kraken may modify, suspend, or cancel this Promotion at any time. Failure to enforce any provision of these Rules does not constitute a waiver. If any term is held invalid, the remaining terms remain in effect. In the event of any discrepancy between these Rules and marketing materials, these Rules prevail. Kraken’s decisions are final in all matters relating to the Promotion.
